PROPOSAL: Approval of the Recommended Actions would partially decertify Second Revised Final Environmental Impact Report No. 616 in accordance with the May 8, 2019, Court of Appeal opinion (Case No. G055716) finding that the Second Revised Environmental Impact Report’s feasibility conclusion concerning solar roof panels was not supported by substantial evidence, and certify Amended Second Revised Final Environmental Impact Report No. 616 as complete and adequate in accordance with the opinion. PROPOSAL –Planning Application PA180050 - a Variance request to allow a minimum side yard setback of 5 feet 1 inch for a 125 square foot bathroom expansion where the E4 District standards would require a setback of 10 feet 8 inches (10% of lot width), and a Use Permit request to allow over-height walls of up to 8 feet and 9 feet along the property’s west and south property line where the maximum allowable height would otherwise be 6 feet.

The proposed new parcels will be 10,805 square feet and 10,003 square feet in area. Excepted as conditioned for right of way improvements, no property improvements are proposed with this application. The existing structures will be required to be removed prior to recordation of the subject map.
